This Acceptable Use Policy ("AUP") outlines the rules and guidelines for using TryOnSmart's AI-powered fashion photography platform. By using our Service, you agree to comply with this policy.

We designed these guidelines to:

• Protect our users and their customers
• Ensure responsible use of AI technology
• Maintain the integrity and reputation of our platform
• Comply with applicable laws and regulations

2. Permitted Uses

TryOnSmart is designed for legitimate fashion and e-commerce purposes. You MAY use our Service to:

• Generate product images for your own clothing and garments
• Create marketing materials for products you own or have rights to sell
• Produce content for e-commerce listings on platforms like Shopify, Amazon, etc.
• Develop lookbooks, catalogs, and promotional materials for your fashion brand
• Test different model types, poses, and backgrounds for your products
• Create social media content featuring your products

3. Prohibited Content

You must NOT upload or create content that is:

3.1 Illegal Content

• Child sexual abuse material (CSAM) or any content sexualizing minors
• Content that promotes or facilitates illegal activities
• Content that violates export control laws or sanctions
• Counterfeit goods or trademark-infringing products

3.2 Harmful or Dangerous Content

• Content promoting violence, terrorism, or extremism
• Content that harasses, bullies, or threatens individuals
• Content promoting self-harm or suicide
• Hate speech targeting protected characteristics (race, ethnicity, religion, gender, sexual orientation, disability)

3.3 Deceptive or Fraudulent Content

• Fake product images that misrepresent the actual item being sold
• Images intended to deceive consumers about product quality, appearance, or features
• Content designed to impersonate other brands or businesses
• Fraudulent or scam-related content

3.4 Adult or Explicit Content

• Sexually explicit or pornographic content
• Nudity beyond what is appropriate for standard fashion photography
• Content intended to sexualize or objectify individuals

4. Images of Real People

Important: Our AI models are synthetic personas, not real people. However, specific rules apply to content you upload:

4.1 You Must NOT:

• Upload photos of real people (models, celebrities, individuals) to generate AI versions of them
• Attempt to make AI-generated images look like specific real people
• Use reference images of real people to influence the AI output
• Create "deepfake" style content using our Service

4.2 You Must:

• Only upload garment images (flat lays, mannequin shots, or product-only photos)
• Use our provided AI model personas only
• Ensure any human elements in uploaded images are incidental and not the focus

5. Intellectual Property

5.1 Your Obligations

You must own or have proper authorization for all content you upload. This means:

• You own the garments/products in the images, OR
• You have explicit permission from the owner to create marketing materials
• You have the right to use any logos, designs, or patterns visible in the images

5.2 You Must NOT:

• Upload images of products you don't own or have rights to market
• Use our Service to create promotional content for competitors' products
• Generate images that infringe on third-party copyrights or trademarks
• Attempt to replicate or copy other brands' distinctive designs or trade dress

6. Technical Restrictions

You must NOT:

• Reverse Engineer: Attempt to decompile, disassemble, or reverse engineer our AI technology
• Circumvent Limits: Bypass usage limits, quotas, or access controls
• Automated Access: Use bots, scrapers, or automated tools to access the Service without permission
• API Abuse: Make excessive API calls or attempt to overload our systems
• Data Extraction: Attempt to extract or download our AI models, training data, or proprietary algorithms
• Resale: Resell, sublicense, or provide access to our Service to third parties without authorization

7. Quality and Accuracy Standards

When using generated images commercially, you should:

• Ensure generated images accurately represent your products
• Not materially alter generated images in ways that misrepresent the product
• Consider disclosing that images are AI-generated if required by applicable advertising standards
• Not use generated images in ways that could mislead consumers

8. Reporting Violations

If you become aware of any content or behavior that violates this policy, please report it to us immediately:

Include as much detail as possible, such as:

• Description of the violation
• Account or user information (if known)
• Screenshots or evidence (if available)

9. Enforcement

9.1 Monitoring

We may, but are not obligated to, monitor content and usage for compliance with this policy. We use a combination of automated systems and human review.

9.2 Actions We May Take

If we determine that you have violated this policy, we may:

• Warning: Issue a written warning for minor or first-time violations
• Content Removal: Remove or disable access to violating content
• Account Suspension: Temporarily suspend your account
• Account Termination: Permanently terminate your account without refund
• Legal Action: Report violations to law enforcement or pursue legal remedies

9.3 Severity Factors

The action we take depends on:

• Severity of the violation
• Whether the violation was intentional
• Previous violations on your account
• Potential harm to users, third parties, or our Service

10. Appeals

If you believe your content was removed or your account was actioned in error, you may appeal by:

1. Emailing admin@tryonsmart.com with subject "AUP Appeal"
2. Explaining why you believe the action was incorrect
3. Providing any supporting evidence

We will review appeals within 10 business days and notify you of our decision.

11. Changes to This Policy

We may update this Acceptable Use Policy from time to time. Material changes will be communicated via email or through the Service. Your continued use after changes constitutes acceptance of the updated policy.
